General Terms and Conditions of Sale
Brigade Mondaine is a trademark registered with the INPI since 2012 under number 3929948. The company MAISON BM is a limited liability company (SARL) registered with the Paris Trade and Companies Register under SIREN number 753 671 684. Intracommunity VAT FR63753671684 and EORI FR753671684.
The company publishes the site brigademondaine.fr, which is also redirected to by the address brigademondaine.com (hereinafter "Brigade Mondaine").
The site allows for the online purchase of designer lingerie and accessories. Any order implies full and complete acceptance of these General Terms and Conditions of Sale.
Article 1. Products and contractual information
1.1 Products
The Products offered for sale are those displayed on the site on the day of consultation, subject to stock availability. They comply with French legislation and applicable standards.
Photographs, texts, graphics, and characteristics are provided for information purposes and do not have contractual value. Brigade Mondaine cannot be held responsible for any errors or modifications.

1.2 Gift Cards
The Gift Card is purchased like a standard product. It is sent by email to the buyer by default, or to the beneficiary designated during the order. It is valid for one year from the date of purchase, is non-divisible, and must be used in a single transaction. It is neither refundable nor exchangeable and is not subject to VAT.
1.3 Price, VAT, and customs duties
Prices are expressed and payable in euros. VAT is calculated automatically upon order validation, according to the country of delivery. Orders delivered in France are subject to French VAT. Orders delivered to another country in the European Union are subject to the VAT of the destination country, which Brigade Mondaine collects and declares via the OSS one-stop shop since July 1, 2021. Orders delivered outside the European Union, including the United States, are not subject to any VAT.
Shipments to the United States. Since August 29, 2025, all goods shipped to the United States are subject to taxation from the first euro of declared value. Shipments are made DAP (Delivered At Place): import duties and taxes are not included in the price paid and are due by the recipient directly to the carrier, notably FedEx, at the time of delivery.
For any order outside the European Union, import duties and taxes are set by the customs administration of the destination country and remain the responsibility of the Customer. Brigade Mondaine cannot be held responsible for delays linked to customs formalities.
1.4 Special and custom-made orders
Products made to measure may require a lead time of up to 75 working days. These Products cannot be exchanged, credited, or refunded.
1.5 Promotional offers
Promotional offers cannot be combined with each other, are valid once per order, and do not apply to shipping costs, unless otherwise stated. They do not apply to Gift Cards or Products marked as non-discounted. They are not retroactive and cannot be converted into cash.
1.6 Product safety
In accordance with the European General Product Safety Regulation (GPSR), applicable since December 13, 2024, Brigade Mondaine ensures transparency regarding the traceability of Products online and in its private boutique. The information displayed comes from the brands and designers.
Article 2. Orders and payments
2.1 Identification
The Customer can place an order without creating an account, or by creating a customer account if they wish. In both cases, they must provide their surname, first name, delivery address, phone number, and email address.
2.2 Validation
Validation of the order implies acceptance of these GTC. The sale is concluded upon full payment.
2.3 Payment methods
The Customer has several payment methods available to pay for their order. The payment is discreet and shows no mention of the brand on bank statements. No additional fees are applied by Brigade Mondaine, regardless of the payment method chosen.
Credit cards and electronic wallets. Payments by credit card (Visa, Mastercard, American Express, Carte Bancaire) and, depending on the device used, by Apple Pay or Google Pay, are processed by Shopify Payments, a payment solution from the Shopify platform certified to PCI DSS, the international standard for banking data security. Payments are encrypted and secured by strong authentication. Brigade Mondaine never has access to the Customer's banking data and does not keep any record of it.
PayPal, in one or more installments. Payment via PayPal allows you to pay by credit card, bank account, or with your PayPal balance. Payment in four installments free of charge is possible via PayPal, subject to acceptance by the latter. In case of acceptance, the contract is concluded directly between the Customer and PayPal, which acts as the lender, without any intervention from Brigade Mondaine. USDC Cryptocurrency. Brigade Mondaine accepts payment in USDC, processed by Shopify Payments, from a compatible digital wallet and on one of the networks offered at checkout. No network fees are charged to the Customer. This payment method is offered based on the Customer's country of residence. In case of cancellation, withdrawal, or refund, the amount is returned in USDC to the wallet used for the payment, on the same network. When the Customer has benefited from a reward linked to this payment method, the refunded amount may be reduced accordingly.
SEPA bank transfer. Bank fees linked to the transfer are the responsibility of the Customer, as Brigade Mondaine must receive the net amount of the order. The Customer should specify their name and the order number in the payment reference. Shipment occurs only after receipt of funds.
Other payment methods. Depending on the Customer's country, other local payment methods may be offered when validating the order.
Gift Cards. Brigade Mondaine Gift Cards can pay for all or part of an order. They are sent by email and are valid for one year from their purchase. The Gift Card is non-divisible and must be used in a single transaction. If the order amount is lower than its value, the balance is lost. If it is higher, the Customer completes the payment with another payment method. Gift Cards can be combined with each other, used with current promotions, and with free delivery. They are neither exchangeable nor refundable, and their purchase is not subject to VAT.
Payment in boutique. When making a purchase directly in the private boutique in Paris 5, payment is made by credit card on an electronic payment terminal. Payments are immediate and secure.
In case of order cancellation at the Customer's request, the non-recoverable fees deducted by the payment provider are deducted from the refund.
2.4 Confirmation
A summary email is sent to the Customer after payment.
2.5 Anti-fraud controls
Brigade Mondaine reserves the right to request supporting documents before validating an order.
2.6 Tax-free purchase
Customers residing and receiving delivery outside the European Union benefit from VAT-free invoicing.
Article 3. Delivery
3.1 Order preparation times
All orders validated before 12:00 PM, Paris time, are prepared and shipped the same day. Orders validated after 12:00 PM are processed the next working day. These times do not include weekends, public holidays, and the annual summer closure period.
For Click & Collect orders, any order validated before 12:00 PM is prepared the same day and available for pickup from 2:00 PM. Orders validated after 12:00 PM are available the next working day from 10:00 AM. The Customer receives an email as soon as their order is ready and must imperatively wait for this confirmation before coming to the private boutique.
3.2 Delivery times
Delivery times vary depending on the shipping method chosen during the order. For France, standard delivery takes on average 2 to 5 working days and express delivery 24 to 48 hours. For international, standard delivery takes on average 2 to 10 working days and express delivery 48 hours.
These times do not include weekends and public holidays. They are given as an indication and may vary according to the carrier, destination, or exceptional circumstances beyond Brigade Mondaine's control.
3.3 Packaging
Parcels are discreet, and Products are protected and wrapped in tissue paper. The name Brigade Mondaine does not appear on the parcel.
3.4 Customs and responsibilities
The Customer must not accept a damaged or opened parcel.
Customs duties and import taxes are set by the customs administration of the destination country and remain the responsibility of the Customer.
The Customer is solely responsible for compliance with their country's legislation regarding the import of purchased Products. Some items may be subject to local restrictions or import bans. For example, scented candles cannot be imported into the United States.
Explosives, hazardous substances, flammable items, and products containing built-in batteries are subject to strict regulations in international transport. It is the Customer's responsibility to verify the possibility of importing these Products into their country.
In case of refusal of the parcel by the Customer, non-payment of due duties and taxes, or local import prohibition, the fees charged to Brigade Mondaine to recover the parcel are charged to the Customer. If the parcel is destroyed by local authorities or returned to Brigade Mondaine, all costs related to this procedure, whether transport, customs, destruction, or repatriation, are also charged to the Customer and deducted from any possible credit.
Brigade Mondaine cannot be held responsible in case of blockage, seizure, prohibition, or destruction of Products by local authorities due to the regulations applicable in the country of delivery.
3.5 Damaged or incomplete products
The Customer must check their order upon receipt. Any anomaly must be reported the same day or the first following working day to contact@brigademondaine.fr.
If the claim is justified, Brigade Mondaine will, at its discretion, proceed with the exchange and re-shipment at its own expense of the identical Product subject to stock, issue a credit, or refund the price of the Product.
3.6 Non-delivery
The Customer has sixty (60) working days from the date of the order to report non-delivery by email to contact@brigademondaine.fr. Any claim must imperatively mention the order number and any useful information for the identification of the shipment concerned.
After this period, no claim can be accepted, as no investigation can be opened with the carrier beyond this timeframe.
In the event of a report made within the deadline, an investigation is opened with the carrier. Processing times vary depending on the carrier and the destination. No commercial solution, whether it be a reshipment, a credit note, or a refund, can be offered before this investigation is closed. If the loss of the package is confirmed, Brigade Mondaine offers, depending on the case and subject to availability, a reshipment at its own expense, the issuance of a credit note, or a refund of the Product.
3.7 Unclaimed, refused, or abandoned package at a relay point
The Customer is required to collect their package within the time limits set by the carrier or the relay point.
In case of non-collection, refusal of the package, incomplete or incorrect address, or any situation resulting in a return to the sender, the return shipping costs and any reshipment costs are at the Customer’s expense. If the package returns to Brigade Mondaine in good condition, a credit note corresponding to the amount of the Products, excluding delivery costs, may be issued at the Customer’s request. If the package is damaged, opened, lost, or declared unfit for resale upon its return, no compensation, refund, or credit note may be claimed.
Brigade Mondaine declines all responsibility in the event of loss, deterioration, or disappearance of a package after it has been made available to the Customer by the carrier, particularly at a relay point or after a notice of attempted delivery.
Article 4. Returns, withdrawal, and refunds
4.1 Right of withdrawal
In accordance with the provisions of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal, subject to the legal and contractual exclusions provided for in these General Terms and Conditions of Sale.
The Customer may exercise this right by means of the electronic withdrawal form accessible via the "Withdrawal" link at the bottom of the site’s homepage, by email to contact@brigademondaine.fr, or by mail addressed to MAISON BM, 4 rue du Fer à Moulin, 75005 Paris.
When the request is made using the electronic form, an acknowledgement of receipt will be sent to the Customer as soon as possible on a durable medium. It shall mention the content of the withdrawal declaration as well as the date and time of its submission.
After receipt of the request, Brigade Mondaine will transmit the return instructions. No return can be accepted without prior authorization from Brigade Mondaine.
4.2 Conditions for returns
Products must be returned within fourteen (14) days following the communication of the decision to withdraw, at the Customer’s expense and responsibility. They must be in perfect condition for resale, unworn, unwashed, odorless, in their original packaging, accompanied by all their accessories, instructions, and intact labels.
Any Product showing traces of use, deterioration, odor, damaged packaging, a removed seal, or any other alteration rendering it unfit for resale may be refused.
4.3 Returns from a country outside the European Union
For any return shipped from a country located outside the European Union, the Customer must imperatively provide a compliant customs declaration and clearly indicate, on the carrier’s form as well as on the package, the mention "Return of goods," specifying that it is a return and not a sale. The Customer is solely responsible for the information provided to the carrier and customs authorities.
If the absence or error of declaration leads to the charging of customs duties, import taxes, VAT, or administrative fees to Brigade Mondaine for recovering the package, these amounts are entirely deducted from the credit note or refund due to the Customer. Brigade Mondaine reserves the right to refuse any package generating unjustified costs or not declared as a return.
4.4 Excluded products
The following are not returnable, exchangeable, or refundable: lingerie that has been in contact with intimate areas, erotic accessories, intimate cosmetics, chest jewelry, foot accessories, stockings and tights, body and intimate jewelry, harnesses and jewelry bodysuits, BDSM accessories, latex lingerie, discounted products, Outlet items, liquidation products, limited editions, and gift packs. Products delivered sealed and unsealed after delivery are neither returnable nor exchangeable nor refundable when their return is excluded for hygiene or health protection reasons, in accordance with Article L. 221-28 of the Consumer Code.
Products customized or made-to-order by our designers for Brigade Mondaine (Qrucifix, Una Burke, Crystal Eyez, FIGURE OF A, HERVÉ by Céline Marie, RE:STRICT), or identified as such on their product page, are neither returnable nor exchangeable nor refundable. These items are manufactured or prepared specifically for each Customer and are subject to specific packaging. It is recommended to come and try them on directly in the boutique.
4.5 Refunds and credit notes
Subject to compliance with these conditions, Brigade Mondaine shall proceed with the refund or, where applicable, the issuance of a credit note corresponding to the returned Products, within a maximum period of fifteen (15) days from the receipt and inspection of the items. The refund is made using the payment method used for the order.
Initial delivery costs and return costs are not refunded, except in the case of an error attributable to Brigade Mondaine or a Product acknowledged as defective.
In the event of cancellation before shipment or in the event of a refund, non-refundable payment commissions charged by payment providers (Shopify Payments, PayPal, or any other provider) are deducted from the refunded amount.
Credit notes are issued as store credit, linked to the customer account, and usable for a future order on the site. They are valid for one (1) year from the date of issue, are usable in a single transaction, are non-divisible, and are not refundable in cash. A credit note used for an order that is subsequently returned can only be reissued once.
4.6 Exchanges
No exchange is offered, except in the case of an error attributable to Brigade Mondaine. Any request concerning a different size, color, or model requires a new order.
4.7 Products available on request
Certain Products are available exclusively upon request. This information is clearly indicated on the product page, as are their specific logistics terms and their specific preparation or shipment time. The Customer acknowledges that these Products may be subject to delivery conditions different from standard Brigade Mondaine shipments, particularly due to their place of shipment, weight, volume, or shipping method.
The Customer has a maximum of six (6) hours from the validation of their order to request its cancellation by email to contact@brigademondaine.fr. After this period, the order is considered definitively validated and committed to the process of preparation, manufacturing, or procurement. It can no longer be cancelled, modified, or refunded.
When the Product is shipped from a country located outside the European Union, the shipment may be carried out according to the DDU (Delivered Duty Unpaid) incoterm. Customs duties, import taxes, and any administrative fees in the country of destination then remain entirely at the Customer’s expense. Such shipments may, in particular, be entrusted to DHL, FedEx, or any equivalent international carrier.
Delivery costs applicable to these Products may be higher than Brigade Mondaine’s standard rates. They are clearly indicated before the validation of the order. By validating their order, the Customer acknowledges having read all these specific terms and accepts them without reservation.
Article 5. Shipping costs
Delivery costs are calculated based on the geographic area, the shipping method chosen, and the nature of the items ordered. Four zones are defined: France, the European Union, the United States, and other international destinations.
France. Relay point delivery: free from 100 euros incl. VAT of purchase, 6 euros below this amount. Economic delivery: free from 100 euros incl. VAT of purchase, 10 euros below this amount. Express delivery: 20 euros.
European Union. Relay point delivery: free from 250 euros excl. VAT of purchase, 15 euros below this amount. Economic delivery: free from 250 euros excl. VAT of purchase, 25 euros below this amount. Express delivery: 35 euros.
Other international destinations. Economic delivery: free from 500 euros excl. VAT of purchase, 35 euros excl. VAT below this amount. Express delivery: 50 euros excl. VAT.
United States. Standard delivery: flat rate of 60 euros. No free delivery is offered for this destination, due to US customs regulations whose constraints and associated fees heavily impact shipping costs.
Free delivery utilizes the least expensive carrier. It is not insured, and delivery times may vary depending on the destination.
Certain items, due to their weight or bulk, may incur additional delivery costs, which is then clearly indicated on the product page.
Article 6. Private boutique and VIP appointments
6.1 Private appointments
The Paris 5 private boutique is accessible by private appointment, for a maximum of two people. Online booking is recommended. The private boutique is not accessible to minors, and animals are not allowed.
The prices in the private boutique are strictly identical to those on the brigademondaine.fr site. The Customer may consult all prices on a tablet provided during the appointment.
Sales concluded in the Paris private boutique are made after the Customer has tried on and checked the Products. They are firm and final and are not eligible for any right of return, exchange, or refund, except in the case of a proven defect or non-conformity in the sense of legal guarantees. The Customer acknowledges being fully informed of the final nature of any sale made in the private boutique.
6.2 VIP Pass and deposits
The VIP Pass is a gift card valid for one year for an appointment in the private boutique. It is indivisible, non-refundable, and non-exchangeable.
Saturday VIP appointments require the payment of a deposit, which is deducted from purchases on the day of the appointment. The deposit is forfeited if the cancellation is not notified at the latest by the day before.
6.3 Tax-free shopping and eligibility conditions
Tax-free shopping is offered to customers residing outside the European Union for any purchase in-store from €100.01 incl. VAT excluding costs, in partnership with FAIR TAX FREE. A commission fee is charged.
To benefit from this, the customer must be 16 years of age or older, reside outside the European Union, and stay in Europe for a duration of less than six months. The original passport is required at the time of purchase. Items must be purchased for strictly personal use, and the purchase must be made in its entirety by the person whose name appears on the tax-free slip.
Services and purchases made on brigademondaine.fr are not eligible for tax-free shopping, which is granted only in compliance with the legal conditions in force.
Article 7. Personal data
The data collected is used for processing orders and managing customer relations. It is hosted by Shopify International Limited, which acts as a processor for the operation of the online store, sending emails and newsletters, and processing payments. Data necessary for shipping is transmitted to Packlink, a shipping management provider, as well as to the carriers responsible for delivery. Consequently, certain data may be transferred outside the European Union, particularly to Canada and the United States, within the framework of appropriate safeguards provided for by the GDPR.
In accordance with the GDPR and the Data Protection Act, the Customer has the right to access, rectify, delete, object to, and port their data.

Article 8. Force majeure, legislation and intellectual property
8.1 Force majeure
In the event of force majeure preventing delivery for more than one month, each party may terminate the sale. Brigade Mondaine will then refund the price of the undelivered Product.
8.2 Local legislation and customs
The Customer must verify the legality of importing the Products into their country. Customs and import duties are the responsibility of the Customer.
8.3 Intellectual property
All elements of the site are protected by copyright and intellectual property law. Any unauthorized reproduction is prohibited. Visuals are retouched and are not contractually binding.
8.4 Applicable law and disputes
These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority.
8.5 Consumer mediation
In accordance with Articles L. 612-1 et seq. of the Consumer Code, any consumer may resort to a consumer mediator free of charge for the amicable resolution of a dispute with Brigade Mondaine, after having submitted a prior written complaint that has remained unresolved.
The competent mediator is the one designated by the FEVAD: FEVAD Consumer Mediator, 60 rue La Boétie, 75008 Paris, France. The mediator can be contacted according to the procedures specified on their website, www.mediateurfevad.fr.
