Privacy Policy
Brigade Mondaine pays special attention to the protection of its customers' personal data and is committed to ensuring the best possible protection, in compliance with the General Data Protection Regulation and the French Data Protection Act (Loi Informatique et Libertés) of January 6, 1978, in its consolidated version. For any further information regarding the protection of personal data, you may consult the website of the Commission nationale de l’informatique et des libertés (CNIL) at www.cnil.fr.
Identity of the data controller
The customer's personal data is collected when visiting the site www.brigademondaine.fr, which the address www.brigademondaine.com also redirects to, by the company MAISON BM, a limited liability company with capital of twenty-four thousand euros, registered in the Paris Trade and Companies Register for the Brigade Mondaine brand, under SIREN number 753 671 684, intra-community VAT number FR63753671684 and EORI number FR753671684, with its registered office located at 4 rue du Fer à Moulin, 75005 Paris, France.
Data hosting
The site is hosted by Shopify International Limited, whose registered office is at 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland. Shopify provides the online sales platform and acts as a processor for Brigade Mondaine.
To ensure the platform functions, certain data may be processed outside the European Union, particularly in Canada, a country recognized by the European Commission as offering an adequate level of protection, and in the United States. These transfers are governed by the safeguards provided for by the General Data Protection Regulation, in particular the standard contractual clauses adopted by the European Commission.
Personal data collected
Data is collected when the customer browses the site, creates an account, logs in, places an order—with or without a customer account—subscribes to the newsletter, uses contact forms, or shares information from the site via social media sharing buttons. The data collected includes first and last name, postal details, login identifier, telephone number, email address, IP address, order history, preferences, as well as delivery issues and complaints. The mandatory or optional nature of each item of data is indicated at the time of collection; certain data is also collected automatically due to your browsing on the site.
This information is used by Brigade Mondaine to process, invoice, ship, and track orders, provide after-sales service, prevent payment fraud, and, where applicable, proceed with the collection of unpaid orders. The processing of your data is based, depending on the case, on the performance of the contract that binds us, on compliance with our legal obligations—particularly accounting and tax—on our legitimate interest in fraud prevention, or on your consent when it is required, notably for newsletter subscription.
Brigade Mondaine never has access to your bank details, which are processed directly by the payment service providers.
Recipients of the data
Your data is intended solely for authorized personnel at MAISON BM. It is communicated, to the strict extent necessary for order processing, after-sales service, and customer relationship management, to the following providers: Shopify, for site hosting, order management, and sending emails and newsletters; Shopify Payments and PayPal, for payment processing; Packlink, the shipment management provider; as well as the carriers responsible for delivery. Where required by law, your consent is obtained or an opportunity to refuse is offered to you before any transfer of your data.
Your data is never sold or transferred to third parties for commercial purposes.
Cookies
Brigade Mondaine uses cookies to, among other things, save the contents of your cart and recognize the customer when they log in to the site. A banner is displayed during your first visit to obtain your consent for cookies and trackers that are not strictly necessary for the operation of the site, in particular those used for audience measurement. These cookies are only deposited after your agreement and are kept for a maximum duration of thirteen months.
You can change your preferences at any time via the cookie management module or disable cookies from your browser settings, bearing in mind that this deactivation may prevent access to certain essential features of the site, such as the shopping cart.
Newsletter
Brigade Mondaine gives you the possibility to be informed of new products and promotional offers by subscribing to the newsletter, based on your consent. You may withdraw this consent, modify your information, or unsubscribe at any time by clicking on the link provided for this purpose at the bottom of each newsletter, or by sending your request via email to contact@brigademondaine.fr.
Social networks
The modules offered on the site, in particular the sharing buttons, allow you to "like" or share a product, article, or any other information from the site on social networks. Using these services may result in data collection and exchange between the social networks concerned and Brigade Mondaine, with each social network acting as a separate data controller for the data it collects via its own tools. We invite you to consult the privacy policies of these networks to find out what information is collected. You can also log out of social networks before visiting our site if you do not want them to collect your information.
Personal data retention period
The customer's personal data is kept for the time necessary to manage orders and associated services, such as warranties and returns. French law also imposes certain retention periods; data related to the customer account is kept for three years from the last contact, and accounting and invoicing documents are kept for ten years. Data of prospects and newsletter subscribers who have never placed an order are kept for three years from the last active contact. Digital data is protected and secured within our IT system using appropriate tools, while data kept in paper format is stored in a secure room, locked with a key and equipped with an alarm system.
Your rights regarding your personal data
In accordance with the General Data Protection Regulation and the French Data Protection Act in force, you have the right to access, rectify, delete, object to, restrict the processing of, and—under the conditions provided by the regulations—the right to the portability of your data. Where processing is based on your consent, you may also withdraw it at any time, without affecting the lawfulness of the processing carried out before such withdrawal. Finally, you may define directives regarding the fate of your data after your death.
You can exercise these rights by sending your request via email to pdp@brigademondaine.fr, or by mail to MAISON BM, 4 rue du Fer à Moulin, 75005 Paris, France. Proof of identity may be requested in case of reasonable doubt regarding your identity. Your requests will be processed as soon as possible, and at the latest within one month.
If you believe, after contacting us, that your rights are not being respected, you have the right to lodge a complaint with the Commission nationale de l’informatique et des libertés, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr.
